Terms and Conditions, Risk acknowledgment & Liability release. 

CHARTER (Certified Captain provided to guide the boat)

After booking you will receive an email with documents in pdf to electronically sign a Risk acknowledgment, Liability release and a credit card authorization form (Risk acknowledgment and liability release need to be signed for each participant that you will not assume legal responsibility for, please provide us with valid email address for each adult expected to come with you or provide their name, approximated weight, and age in the provided form that will need to be signed before departure if it was not electronically signed by each of them. On the tour date you and your group will be given a short but thoroughly brief of the emergency and safety procedures and rules and you will sign an acknowledgment of the boat physical condition. Financial responsibility could be  attributed to you for any incidental damage(s) that you or your guest could cause to the  boat. The Credit card authorization form should be completed with enough time in advance before the trip to allow for your financial institution to authorize a "pre-authorization amount" usually $350 but this amount would be greater for  tours with group of more than 6 passengers.

RENTAL (No Certified Captain provided, You or someone in your group will command the boat)

After your booking some important documents will be emailed to you. All this documents need to be signed (usually for your convenience electronically signature ready pdf will be provided) to properly fill and sign all of them is an important condition for the rental, this document would be: Rental Agreement, Risk Acknowledgment, Liability Release, Credit Card Authorization Form, and a Statement of Previous Boat(s) Kind and Length of Time Owned or Operated. (minimum two years previous experience required*** and 21+ Years of age to sign the rental agreement) During the check in you will inspect the boat, receive and orientation regarding boat , water area, and other required information including boat handling characteristics and safety and emergency equipment location, use and procedures, An stamen of Physical Condition/Inspection of the Boat, and an orientation form will be signed also. Please read them carefully and feel free to inquiry us about any concern or especial needs.  

***Certain exclusions apply: Master, OUPV, or commercial or approved equivalent MMC endorsement holder are exempt from some of these requirements.

*Please bring your driver license or other valid photo ID.  You must be physically in possession of your ID and other required certification during the rental. *You must comply with all local, estate and federal laws.

Free pre-trip rental  instructions.

*knowledge of local waterways is required or you would be asked to complete an on the water orientation with our NASBLA certified instructor, this orientation could be 1 or 2 hours depending on your specific knowledge. You are responsible to comply with all regulations and present the required documents before the check in. You must also be capable of safely operate the boat, if our operator, agent or instructor determines you are not eligible to operate the boat, the rental will be cancelled. 

You are assuming liability for yourself and your guests actions and any injury, lost or damage to the boat, people onboard or around the boat and their properties.  By booking with us you are expressly authorizing Captain Aragon LLC to hold your credit card on file and to charge your credit card in the event of any damage or lost of equipment, parts, inventories, your dues, fees, security deposit and penalties, insurance deductible and/or out of pocket expenses that could apply. 

It is your responsibility to document any existing damage, wear and tear, scratches, defects and all items in the inventory list before taking possession of the boat and upon your return you can be found responsible for any  additional damage that was not previously noted in the contract or any missing, damaged or malfunctioning item, equipment or inventory. You must wait until the boat is completely assessed and inspected and should not leave until the Company agent or operator has finished and cleared the returned boat physical condition in the contract. Your signature upon return it is not necessary to stablish your responsibility.

Operation:

 *LESSEE assumes all the responsibilities arising from the operation of the vessel understanding that during the lease period he/she will be in legal possession of the boat as it is generally understood in the maritime law pertaining a bareboat charter without prejudice of the provision of the rental agreement and to the extend allowed by existing laws and regulations.  If any part of the contract is deemed void/revoked or inapplicable by a court of law or regulation, the rest of the contract will remain in full force. 

No nighttime operation allowed unless agreed in writing.

If you are renting for more than one day and want to keep the boat at your local on the water residence or rental property send us the address to verify the property docking is safe and meet the minimum conditions to safely keep the boat made fast and secure.

We could deliver the boat and pick up from your house by the water.  (this service will be free is you are renting for 3 days or more.) Certain restrictions apply (generally speaking limited to the SE Cape Coral salt water canals and most of the SW area ) * more than 1 day rental will return the boat by 4:00pm on the last day contracted. 

Returning:

*You have to bring the boat back in as good as a condition as received and with same amount of fuel and inventory. Marina fuel receipt must be presented at check out. For your safety non-ethanol gas only.  Return  must be on time, if for any reason you believe will not make it back between the contracted time, call the office representant or the operator and let them know in advance. A late fee could apply in some cases but our goal is to provide you the best experience possible, will try to be flexible for your convenience but within some administrative and operational limitations that could eventually result in the need to charge extra fees when contractual terms are violated. 


Minimum Security Deposit:  Rental ($1500)  Guided Charter ($350): A hold not a charge will be entered into your credit card to make sure you have sufficient funds available in case the unexpected happen. If for any reason your financial institution do not accept the hold, a charge will be made to be kept as a security deposit and will be refunded or release as soon as the boat is back and cleared, this process is usually no more than 48 hours after the boat is returned. After the funds are released/refunded timing varies depending on your financial institution. It isa condition for the tour/rental and your responsibility to provide the security deposit, failure to secure the funds before the trip could be basis for cancelation without refund.   Cancellation policy: If you book  with more than a month in advance the pick up/rental date, generally if you cancel within a 72 hours of having made the reservation we will refund 100% after that time and up to 30 days of the pick up or rental date we will refund 70% . This  strict cancellation terms policy is needed to prevent the damage that fake or deceiving reservation can inflict in small rental business with limited assets.   From that time and up to 72 hours before the pick up/ rental date we will refund the 50%  unless the cancellation occur the same scheduled pick up/ rental day in that case no return would be issued. When Inclement weather make it unsafe in our opinion to proceed with the activity or for other force majeure occurrences, otherwise and under certain circumstances  the operator could in a case by case basis  issue a full  or partial refund or reschedule the booking at his sole discretion.  In cases when the rental has been cancelled because you do not meet the requirements  of an existing law or regulation, the general cancellation policy will apply. If our NASBLA certified instructor  determined during the "On the water orientation" that you are not eligible to operate our boats a refund could be issue based on the general cancellation terms for any remaining time and percentage as described but a service/delivery/pickup  fee of $80 is non refundable plus Instructor fee of $120  (this last is for rentals without captain and only apply to people without proven boater experience, documented knowledge of the area or first time renters) this instructor fee where apply is non refundable. We are committed to be always on time none the less there is a half hour allowance for renters and operators pick up.  Please give us a call if you are running late, after 1 hour delay the booking could be considered a no shown and cancelled without refund.
